That may be the advantage for the lessor, but that line of reasoning is not why buyers are getting into smartleases. They're getting into it because a) you're not locked in like you are in a traditional lease (good deal) and b) the tax advantage (also good deal).
I could care less if the leasing company is sued in case I happen to get into an accident. Does it matter? I have insurance. That is not the reason I considered a smartlease!
When was the last time anyone considered buying a car because their lender might be sued if they get into an accident?
Hyopthetical conversation:
Dealer: "So, how would like to finance your car? We have several options-we even have one where your lender doesn't get sued if you get into an accident!"
Prospective buyer: "Oh, tell me about that one! I'm interested!"
You can see what I mean. it seem kind of absurd. (running and ducking) ;-)
Your point is well taken, though. However, if that WERE true-then my question is: does your bank get sued if you get into a car accident and you took a loan out for your car? What's their liability? You're the one driving, not them!
