The mileage is not better.
I agree that the air filter is a restricion to the incoming air and therefore would contribute to pumping losses. However there is a much larger restriction to the airflow in that of the butterfly valve.
Think about it for a second though. The way we control engine power output (On most gasoline engines) is by reducing the flow of air into the engine via the butterfly valve. (This causes pumping losses) So for a given power output we need a certain amount of restriction on the incoming air. Whether we achieve that restriction through the butterfly valve or the air filter is meaningless until we get to the point where the butterfly valve is completely open. At that point the airfilter is the restriction that is limiting power.
Since fuel economy is usually not measured at WOT reducing the throttling effect of the air filter will have no real difference on it. At WOT however a freer flowing air filter will reduce pumping losses and may show a small gain in power output. (Only at WOT though...)
I have also seen test reports from a supplier that showed K&N filtering ability and to my great surprise it was not better than the good standard element fitlers. (Flow was)
The OEMs are not as stupid as many people like to think. One of the measures we look at for technologies that effect fuel economy is $/mpg. Stuff that costs $100/mpg is consiered cheap.
