I don't think anyone can go replicate a patented part without a license, even if its offshore, without agreeing to maintain some standard of quality. SAAb must still own the design rights to its control arms, so they can't just be manufactured by someone else.
As a kid I worked in an aluminum casting plant one summer and a local baker came in and asked the boss to replicate a two foot tall J shaped aluminum stirrer for a big industrial mixer. An OEM piece was like $300, the baker asked for something similar for $100. Looked simple enough, the proprietary issues were how it hooked up to the mixer. The boss turned him down, saying that if he was ever caught reproducing an item that someone else owned the rights to, then he would be in legal trouble. I learned a lesson.
I'm not defending or associated with ScanTech, never bought from them. You may be right about OEM vs non-OEM, but I just think a seller can't start copying things without some of these issues being addressed. Poor quality would eventually hurt the SAAB brand and SAAB would have an interest in preventing that.
