Tow it to the other shop. Tell them your history with this guy and that you want them to be your new shop - maybe they'll eat the tow charge. Be present when it's towed. You need the car and tell him you have to get it on the road - one way or another. He's shouldn't have taken the work if he couldn't get to it in a reasonable time - or should have told you it would be delayed.
He may be telling the truth (although I've heard the jury duty line before), but it's two strikes and you're out for me. I'm very picky and any repair issues (delays or "found" problems replaced w/o consent) usually means I'm not coming back.
