Yep, normally they do, but in order to meet any of California's xZEV emissions criteria, the manufacturer must include the air filter as part of the warranted emissions equipment since replacing it with an aftermarket part might change the tailpipe levels. I was wrong about the 10 year warranty, however - it's 15 years. Here's a quote:

"To achieve a PZEV rating, a car must meet the California Air Resources Board's cleanest tailpipe emission standard, Super Ultra Low Emission Vehicle, and it must have nearly zero evaporative emissions, such as the gas vapor that escapes even when the car is parked. Finally, the car's warranty for emission-control equipment must be good for 15 years or 150,000 miles."

Also, from an article about the Ford Focus - the first (and only) vehicle in 2004 to meet PZEV:

"Under the hood the standard 2.0-liter engine has been replaced with a 2.3-liter DOHC 14 four-cylinder power plant that is rated SULEV. . The Engine has also been modified to lower oil consumption and the air filter has been designed to last for 15 years before it needs changing."

There are some more information on Visteon's website and of course the California ARB website, but this is what's relevant.

I did quite a bit of research on the 2004 Foci, as the California & Maryland only ones came with a sweet 2.3l four... the low-emissions version of the MZR from the Mazda6. That nasty 15yr air filter alone traps about 10hp...:D
