I don't mean to pee on your parade, but whose fault the accident was is likely irrelevent once the insurance pays you for the "value" of your car. Now since the accident wasn't your fault at all, your insurance premium shouldn't increase. That's the benefit of being the innocent party. If the car is totalled, and you want it back, the best you can hope for is what whitesaab said: buy it back and make the best out of a lousy situation. I don't know how you can force the other party to buy the car from the insurance company for you.
