3rds and 2nds re smog and ownership.... as anders and justin say, the seller has to provide the smog certificate. unless the buyer purchases it with the understanding that they as the buyer will get it done. if you buy from a used car lot, if it was done within 90 days prior i believe you can still qualify under that one.
also as justin said, i'd be way more concerned with the title status. if the person you're buying from didn't get it smogged, did they even register it also?
i purchased a car from a person who had done this same thing. i did 98% of my due diligence, but it was that small part i missed that cost me big time.
turns out the owner had just been driving it with swapped tags, with the prior owners name still on registration per dmv, with a lien on it from the finance company, and not registered. make sure the seller has the pink slip with their name on it!!
end of a long story, i had to file paperwork to get finance co to sign off on it, i had to pay past due registration fees, get new plates, get duplicate pink slip and get it smogged.
before you buy it, check with the dmv regarding ownership, and also if it has outstanding fines for past due registration or suspended registration for not having insurance or too many tickets. if you give the dmv the registration numbers from the tags they can tell you if they are for that car as well.
if you buy it as is, with no smog, take it to a free retest smog place during your inspection drive so you will have an idea if it will pass or is a gross polluter or an expensive to fix smog fail. if it passes, great. if not, you have your free re-test for after you fix it. it will also give you some ammo if it comes down to haggling over price.
