i hit a huge hole in a snowstorm in illinois 5 hours from home, and 18 hours from my destination. Bent my rim in two places, and knocked me out of gear... thankfully the rim was repairable, so in my case it was a minor setback.. no injurys to my passengers or my dog (who actually wears a seatbelt too).
first thing i would do is go back to the spot where you hit, and take some pictures of it, including putting something like a ruler/measuring device in the pic so you can show the actual size of the canyon you hit. call your city hall or county court and find out what the process is to report these accident and file claim. i can't see how they can in any way prove your negligence... whether it's raining or snowing and say you were driving 15-20mph, a pothole of that size filled with water is a danger to the public.
good luck!
Rachel
