You may have two switches on the brake pedal, assuming you have an automatic; one to cut off the cruise control when the brakes are applied, and one to turn on the brake lights.
Look for a switch at the top of the brake pedal and see if you can remove it and make the switch extend further out. That should allow the plunger to contact the pedal in the full up position, which opens the circuit, turning off the brake lights.
Other thing you can check is to make sure your brake pedal is returning fully when you release; if you have a problem where it doesn't come up all the way, the switch will remain closed- in that case, the switch may not be the problem.
