I would guess (I don't know what state your're in) that since the tire is considered property or a possesion, that the people would be accountable because it was their property that caused damage. I would get the plate # and file a police report as property damage, not an accident. Your insurance may not surcharge you for property damage, or you could fight it. That's my $0.02.
