9-3 Convertible brake question

I posted a few weeks ago about my gf buying a 9-3 Convertible. She found the exact one she was looking for, we test drove it and it was great. The 2 MAJOR problems I noticed were:
1) when stepping on the brakes, we had to apply alot of pressure. This didn't seem right. It felt worse than my old cherokee in terms of stopping power. Is this common among the 9-3 Convertibles? I testdrove one in December and I don't recall the brakes being this poor. How much would it cost for a brake job on this car?
2) passenger driver's seat has to be coaxed into going back. This isn't that big of a deal since it will almost always be in the full reverse position. How much should this cost to fix? I'm thinking it could be a small simple problem with just a button thats not right.

This is for a 1999 convertible with about 46,600 miles on the odo. manual transmission etc. He is asking a tad over 16k with edmunds listing it at 14.9k(he owes 16k so wants to break even, but we wont pay off his loan to get the car since it isnt worth that much). If we do decide to make an offer i'll need to run a carfax on the car and then have a mechanic look at it.
