should contact his insurance agent first and make the claim. If the other driver admits fault or was tickted. You might have to sumbit a copy of the police report. Take notes everytime you speak with a claims agent. I'm sorry your insurance co is very unhelpful, you might want to consider looking for a new agent. They could have at least outlined the process for you.
You have the right to chose whomever you want to fix your car. Often insurance agencies have "perferred" vendors that, if you choose to use them, the agency will be direct billed and you should pay nothing out of pocket. Sometimes, if its not perferred, you pay out of pocket and the agency will re-imburse you. The agency should also pay for a nice rental car and any towing that happens.
I think you only need a lawyer if the other driver doesn't admit fault and his agency won't pay OR the agency won't fix or replace your car to your satisfaction.
I'm sorry to hear about your accident. Kinda a crappy welcome to the US, eh? I was rear ended earlier this summer, so I'm all to familar with this still. :(
