Sorry to hear of the accident and I hope your aches and pains will moderate quickly. I'm not a lawyer and I have never sued anyone in my life but I've become increasingly more annoyed having thought about your situation for the past 12 hours. Why should you have to worry about this guys' insurance company as it relates to the value of your car + the modifications? The 3K in mods would be 6K+ if you didn't DIY so the value should be based on your replacement cost in my view. (I'm basing this strictly on the fact that you did not cause the accident). I'd get a lawyer, tell him/her I want ???? for the car and you'll sign off on future litigation. I know it was a "smallish" SUV but those things are marketed that in an accident the driver will walk away and never mind the other guy. The fact that your exhaust went under his vehicle speaks to that design element. Guys driving those things should take the heat and added responsibility for accidents they cause because they can inflict greater damage to others and in part that's why they buy them. The other insurance company should do the arithmetic and be grateful for a settlement. Just my two cents and the important thing is you are alright.
Also, I think the fact that you did not cause this or other accidents speaks to the attention you have given your car in terms of enhanced handling, braking, reliability and responsiveness: safety factors all for yourself and those around you.
