Lesson one. The insurance company settlement is an offer. They offer you the least they can. You counter their offer with your offer, supported with samples of recent sales of similar cars, or advert's of similar cars with asking prices. TSN is a great source for this information.
Also gather any receipts for any work you have done to the car in the last year. That *may* be taken into consideration when valuing your car, leading to a higher settlement for you.
This all assumes you have more than just basic liability & he has insurance at all.
Do not sign anything! Read any papers (including the back of any checks) very carefully. The insurance will want you to sign away your right to bill them for future medical coverage. I have found that the true pain show's up 1-2 days later. Be sure you are really well before you sign away your recourse.
Be sure the police report is correct. Review it & ask for any needed corrections to be made - errors do show up. It is very important to you that you are not found at fault. Fight for this. If you were right, don't settle for an easy closure that suggests you were partially at fault. That would show up to haunt you for years to come.
