I need a lawyer, I think.
I have an ongoing problem which I'm not entirely sure what to do about - I'm wondering if maybe someone else has been in the same situation, or has some related experience that might be of service...
In short: In May of 2004 someone side-swiped my Volvo on the freeway. I reported it to the insurance company, and in standard insurance fashion "the repair cost exceeds the value of the car, so we're totalling it." Fine, I got a check for $1500, wrote a check for $1450, kept driving the car.
December of 2004 I went to the DMV to walk-in a registration renewal for my 1995 Alfa 164Q. I'd delayed mailing it, needed it legal that day. The nice lady at the counter told me I'd have to get a Brake & Lamp Inspection and apply for a Salvage Title before I could register it.
"Excuse me?!?!"
A few phone calls later I discovered my insurance company had "accidentally" totalled the Alfa instead of the Volvo. I see how "Alfa 164 Quadrofoglio" and "Volvo 740 Turbo" look similar. Whatever. The solution, they told me, was to write a letter to the DMV and reverse the action. I had them fax me a copy of the letter and walked it to the DMV, just to be sure it got there.
Well, it's almost ten months later, my Alfa is languishing in the garage, and I still do not have resolution. There were "problems" with the paperwork, "delays due to the DMV," and a "misunderstanding" by the person who originally was handling the case all which led me to a conversation today informing me things should be resolved in four to ten weeks. Probably.
I am not entirely certain what I should do at this point. I want the issue fixed, and to be honest I want some restitution for wasted registration fees, storage fees, insurance premiums, etc. But, I don't want to be too obnoxious until the issue is fixed.... I don't think threatening folks will make this go any faster, but it's really difficult being patient while a seemingly simple operation takes nearly a year to complete...
Probably not important, but the car is insured through American Express Property & Casualty... not exactly a small operation.
Any thoughts?
