Emissions testing is typically only done at one rpm, perhaps where the engine would be at 60 mph in top gear?
If you're getting popping on acceleration, you could try a higher octane, although I thought that H-D's ran fine on regular. Perhaps they leave the factory mis-tuned. That would be a great way to get you to spring another $1000 for a different exhaust a week after buying the bike. It's probably the same reason that H-D puts such crappy seats on most of their bikes, so they can sell you another one for your brand new bike.
Your engine is a dinosaur, and it is headed for extinction. Emission testing probably will kill H-D's air-cooled engine. Expect to see the Porsche collaborated V-Rod water-cooled engine expanding in the H-D line. It is a modern engine, and should be able to meet future emission requirements.
Oh, don't try to tell us that guys put straight pipes on Harleys to get their horsepower up to at least half that of a 600cc ricer, they do it to make more noise. The sound of a Harley is a big reason for buying one, otherwise, why are you guys constantly blipping your throttles?
Myself, I do have an after-market slip-on on my bike (a Micron carbon-fiber high-mount). The racing-inspired VFR V-4 engine has a wicked sound, and the stock pipe was very quiet, and my high-mount shows off the single-sided swingarm. I would never consider running a straight pipe on my bike, that would be too loud.
