Of course you can (legally or not, and I understand your suggestion is perfectly legal) work around iTMS's DRM, but why should I have to do that? If my goal is to get music onto a CD, I'll just buy the CD. Then it's in its original format and I am free to encode it however I want. Your suggestion about transcoding to Vorbis is silly. All that will do is result in a file that sounds much worse than either the source MP3 or the original recording. If I buy the original CD and music formats change, all I have to do is reencode to the new format, no transcoding needed.
The scariest thing to me is that Apple is free to change the DRM restrictions whenever they want, without notification. A couple years ago, they changed the number of times you could burn a playlist from ten to 7. That's something that probably won't trip up most people, but it does show that Apple calls the shots regarding the music you buy from them. If they really wanted to, they could remove the ability to burn purchased tracks to CDs.
BTW, my original message was meant to refer to any store that sells DRM music, but Jim was specifically asking about iPods so that's what I focused on.
