OT: Bad web ordering experience, now what?

I've ordered items off the web for a long time with relatively few problems until now... I ordered some items from this web site a couple of weeks ago, haven't received anything yet. Then, got an update on my order stating that the items I've ordered are on backorder for couple of weeks. I don't have time to wait so I reply to the email that I would like to cancel the order. Get an email back stating that it won't be a problem, just going to charge me a "cancellation fee", a percentage of the order total (around $10). This cancellation fee is in the "terms of sale".
My problem is that when I ordered these items, there was no indication that they were backordered and I got no email that they were backordered until 10 days after I placed the order. I don't feel that I am at fault, thus shouldn't have to pay a fee. Maybe I'm just impatient, but I really dislike it when people leave me in the dark or give me a run-around. I'm about done with the company so I really don't care if I tick them off.
My thought is that I call my credit card company, have a new card issued with a new number, and void the old one. Then, cancel my order (or just let it go) and let them try to charge the invalid card number. What I'm wondering is that could they turn this over to a collection agency or something worse? Any thoughts?
