Ultimately I don't know. In reading through some of the fair credit collection stuff they are clearly restricted in what they can do and how they present it and what sort of qualifications they might need to include. However, it seems to be about fair and lawful representation.
Given that their goal is to get a commitment and some sort of payment many collections people probably do regularly cross the line. Personally I still get the sense they can mention the intent to get a garnishment judgment if they do it properly and are at that stage. The goal seems to be to prevent indimidation, misrepresentation, and the implication of taking an action that is unlawful or not possible.
So if it is their intent to get a garnishment judgment and they intend to do that and present that properly I would think it is OK. If they don't mean it or it isn't lawful in this case or don't present any other information required by law they would be in the wrong. If they are simply saying we will start garnishing wages if they don't get paid then yes I would agree with you b/c they can't start to garnish wages without a judgment. But if they are simply saying they are going to begin procedures to obtain a garnishment judgment that might be OK.
