About a year ago I wrote here, telling about a failed pre-purchase repair on my new Aero. Most of the suggestions recommended accepting it and moving on.
recap of the saga:
my new 2003 Aero suffered a ding in the rear bumper while on the car dealer lot. It was repaired and sold as new without notice.
Starting at ~4 months it began falling apart and continued cracking and losing chunks of painted filler. Assuming it was a parking lot ding, I took it to a body shop. He said it was a failed repair, as this type of bumper can not be repaired, only replaced. A second opinion confirmed that
Back to the Dealer- no record of such a repair. SAAB USA denied any repair while in their custody. BUT we find a) sales dept. records are kept separately from service records, and b) the dealership was sold a few months ago and the old owner had the records.
ensues- months of not answered phone calls, letters - then offer to repeat the repair, which I declined.
I paid $950 to have a replacement bumper painted and installed and sued in small claims for payment. Day in Court last Wed. Today I received notice of decision in my favor for $950 + court costs.
Victory. That works out to about $10/hour. But it's worth it.
apparently repairing body damaged new cars on lots is a common event, and in California the dealer is not required to tell the buyer unless it costs > 3% of the car's price. So, if you have some flaking paint or body panels that don't match- dig deeper.
