Most spam these days has innocuous subject lines to get past the spam filters. It would make sense that innocuous subject lines from spam generators would end up matching innocuous subject lines from your normal email - that's the idea. Something about lunch being repeated isn't much of a surprise. Mayors and carpenters, more so.
Now, if you get a spam email with the same subject line as a personal email like 're: torque setting for model year '86 tripod bearings is 73 ft-lbs' and it was indeed the right torque setting, then I'd assume either you or your correspondent's computer has been infected, and is being used to generate spam itself. Such 'zombie' programs are alltogether too common.
And can someone listen in on your email? Yes. And it isn't just the folks from the Patriot Act. However, they are more likely to be trying to steal credit card and other personal information, and would want to stay under the radar. As an example, at my company, we are specifically barred from putting any company private or confidential information on the public internet (VPNs OK) unless it is encrypted. And the same is true for any export-restricted data.
