Speeding ticket question for you legal types out there. I was pulled over for speeding in December before Christmas. 20+ over limit and 6 points. Ouch. So much for not using a radar detector while in the city. I feel that I have a case against the officer’s radar since there was another vehicle attempting to overtake me in the next lane at the time he measured the speed. I highly doubt that our fine men in blue would spend the money for a laser so he was probably using common K-band radar.
Since I obviously wanted to fight this ticket I went to municipal court last week for the court date. When I went to check in with the court clerk she checked her computer and informed me that there was no record of the citation in their system so there was no case to try. She said most likely the officer had not turned in the citation yet. I found that hard to believe since the ticket was issued by an in car computer, not hand written and almost 2 months had passed since the ticket had been issued. I received a letter from the clerk indicating that I appeared on the court date posted on the ticket if I get any further action taken on the ticket. She said most likely I will get a notice in the mail of a new court date. Since I already took time off work to go to court once, I am wondering if I can contact the DA and move for dismissal of this ticket since I showed up on the appointed date and the prosecuting officer (city) wasn’t prepared to present their case. In the real world, this would be called a forfeit, but I’m sure it doesn’t work that way in the wonderful world of government. Should I contact the DA and see if I can have the ticket dismissed or just wait and see if it just goes away? The clerk said that no action would be taken on my license until the case would actually go to court.
