Dishwasher drain / air gap install Q

Trying to fix the dishwasher at my sister's place, there's an "air gap kit" thing that pokes up through the sink shelf (just next to the faucet). When the DW runs, water comes pouring out of there, and all over, not just into the sink.
I've traced that there's a hose from this air gap thing to the disposal that should be replaced - old and cracked. And this air gap thing needs to get reinstalled with rubber gaskets instead of putty, don't cross-thread the plastic bolts, new clamps, etc. Just re-do the whole thing over with new.
Here's the Q:
1. Is this thing supposed to drain out the top of that air gap thing into the sink? H2O was pouring out of it - I'm going to clean it to see if it's not blocked. Seems to me not, that the air gap thing is supposed to let the H20 flow into the drain better.
2. Can I just drain it into the disposal? 86 the air gap thingy? That's how I did it at my old house. The directions show either way but speak of building codes ... and it's a condo ...
