Many people are confused about this, so don't feel bad.
You can read about this in your state's driver's manual. It's all in there and you had to learn about it when you were getting your learner's permit.
On a multi-lane road if your "pass" someone, the official term is "changing lanes". Your are NOT passing, unless you are on the shoulder or in the opposite lane (where the oncoming traffic drives.) I would guess that >95% of Americans don't know this distinction.
You say you pass the "bozo" but officially you are just changing lanes and driving. NOT PASSING.
Driving in the right lane faster than others drive in the left/middle lane on a multi-lane road is not legal in "most states." It is legal in ALL states. It is NOT passing on the right. It is driving in the right lane. Understand?
