From Neil's posts he has no question that he will get his money back. What he wants is specific performance, e.g., that the seller be compelled to transfer the car to him. That remedy does not exist in Anglo-American jurisprudence, absent very unusual circumstances which I do not believe exist here. I don't see how eBay could compel the owner to transfer the car to Neil, or deal with reliance damages such as a hotel room. He could try small claims court for that but probably more of a PITA than it's worth.
I have never bought or sold anything on eBay, partly because of potential for crap like this. YMMV.
