They can cite you under 'unreasonable conduct' for not wearing shoes, and they do all the time, because people don't know better. It's one of those 'judgement call' things then. I talked to a prosecutor about it, he said he's seen that cited (as 'unreasonable') alot, but always as part of multiple citations.
Generally, if the other citations involve an accident, you're done. It'll stick, myth or not.
Along with a moving violation, while he's never seen it challenged, he thinks bringing up the lack of statute on the the issue might get the foot charge thrown out.
