I think this is a good question. I have been thinking about selling my expensive and much loved motorcycle and don't know what I will do if someone wants to test ride it prior to agreeing on a price and starting the sale. My last bike I told the buyer he could follow me in his car (or try to)while I rode the bike hard and hear the engine, etc. I think I gave him a written "warranty" that there were no problems for 48 hours or something. I don't remember. The dealer I bought the most recent bike from didn't allow a test drive for liability reasons but had a no questions asked return policy for a short time and the bike was under warranty. They wanted the title transferred before I rode the bike and this is a very large dealer (I never saw that before).
I know a bike is much more dangerous than the car but I would be interested in hearing about a case where someone actually did have this problem and how it was resolved. Would the owner be liable for injuries the test driver or others got during the test drive? I assume damage to the car would be on the owners insurance. Has anybody seen this happen?
