If it is truly "switched" power (green and white wire) then why would the fan run when the car is turned off? Something isn't right there. I agree, a fan should have a relay. They draw some amps and should be set up accordingly.
I'm sure there are personal theories on fan placement. I've never seen a definative study but I'm sure there is one out there. You will more than likely have a lot more room (you are running with a cold air intake, I gather) to install it as a puller. As well, I can't imagine the fan is set up to run either way. They are usually one or the other.
