Under the Magnuson Moss Warranty Act if we win the Dealer is responsible for my Lawyers fees. I pay $350 win or lose to the lawyer to get the process started. If we win Saab has to pay my lawyers fees if we loose my lawyer gets NOTHING. Thus they wouldn't take on the case if they didn't think we had a good shot at winning. This warranty act protects the consumer financially and makes the burden of proof on the manufacturer. The dealer has 4 attempts to fix a reported problem, this means that if they issue the tried and true response of "unable to reproduce problem", this counts against them. So the most i could lose is $350. Plus we were smart and got our starting problem on video tape. This way the dealer ship can't say we made the whole thing up. I highly recommend that if possible video tape the car to get the issue on tape. Suing is scarry but consumers need to do massive research and contact a lawyer for assistance. Hey, after all is said and done i lost $350 and have a car to get rid of or i could win. It's better than just accepting that the car manufacturer is playing the numbers game with me, most consumers don't do anything and they count on that...
