What hombeuilders like Pulte do is use every square inch of land. They do set aside open space, but that open space is not sited to provide a buffer for either current or former residents, it is done to transfer zoning density from unbuildable land such as wetlands and flood plain.

I understand the argument that the guy who bought the new house should have realized that he had no buffer. But that's water under the bridge. He is there now, and you are stuck with him as a neighbor.

The good news for you is, you have 5 acres. You can provide the buffer that will benefit you. That it also benefits him does not cost you anything.
