I can assure you this is a huge frustration to many of us in the US, but as we have dealt with it so long it's actually amusing to hear someone shocked by it! Many, many drivers will hold the passing lane and nothing you can do will make them move over. This often creates dangerous situations of cars bunched up in traffic, tailgating, passing on the right, etc. I really can't understand why these drivers think this is acceptable. How common this is seams to very depending where you are in the country, but it does happen everywhere. The best think to do, in my experience, is give them a bit of time to notice you, and if they don't move over just go ahead and pass on the right. If they are discourteous to not move over initially, flashing lights, etc. are not likely to help.

In the US, traffic law is defined by the states, so it actually varies depending where you are. However, in general:

1) Yes, passing on the right is usually legal
2) In many places holding the left lane in not legal, though this is not enforced
3 & 4) No one, as any laws on this matter are rarely enforced. Unless you are being really out of control, the only thing you are likely to get pulled over for on a US freeway is speeding.
