Law is too complicated to discuss on this board (and some things you want confidential) but I will tell a story about when I was fixing cars semi-professionally. We did a tuneup or something on an old Mercedes. It involved adjusting the valves. The owner asked if the car would make it to Minneapolis (from Iowa). I said it probably would. The valve cover retainer bracket failed (sometimes they would rub on the camshaft) and he kept driving even though the engine lost its oil. Obviously the engine seized. He sued us in small claims court and we had to settle -- paying him.
Especially when you are on your own and really work to develop goodwill it's easy to let be too friendly, informal and let your guard down.
Should we have had a written warranty? You bet. Was the guy an idiot for driving without oil? Form your own conclusion.
Could it be explained as a simple misunderstanding? Maybe. And this last is the best reason to get things in writing. If it's written down, then there is less likelihood of misunderstanding.
Oh, and I got out of fixing cars and went to law school. Not because of the suit, but because it's easier to keep the grease out of your fingernails and a lot warmer in the winter... .
