CPO question-should the dealer have known?

Last week I purchased a 2002 Arc with 40k miles. It was CPO. Within 4 days the battery died 100 miles from my house. I drove home and left it with my indy shop, who replaced the battery. I did not contact the dealer because it was a Jewish holiday and I was in synagogue.
The indy shop charged $240 for evaluation and replacement. The dealer is only willing to reimburse me $100 and says the battery was fine when it left the dealer.
Question: Should the CPO inspection have revealed that the battery was on its last leg with less than 150 miles of life. If so, is that a sign that the CPO inspection was not done propery and what recourse do I have?
