I think this is a common problem with this car. I to had the same problem. I actually took both rear rotors apart and found that the driver's side pads and rotors were very worn (brake dust inside the rotor...remember the emergency brake works the inside of the actual rotors). The passenger side was as clean as a whistle. I think there is a design flaw or something. Every problem account I have heard of has been with the diver's side rear brake. Maybe the fact that the muffler runs so close to the brakes it causes extreme conditions for the driver side rear brake?!?! Just a hunch.
I cleaned and greased the components of the emergency brakes and it has been working fine ever since. When the problem first happened to me it was also with a foot of snow on the ground. I was actually driving with the rear wheel locked. I crawled underneath the car and released the emergency brake mechanism (at the rear wheel) by hand.
Good luck and let us know what the dealer did.
