convertible top motor & insurance company problems.....

Hi,
My 1987 900TC was broken into a few months back. Beside breaking the rear convertible top window, they unhinged the top and forced it back almost halfway to get at a large box that was in the back seat but too large to get out through the doors. Since then my power top would not work, although I can hear the motor running. The top worked just fine before and it actually had both rams (piston/actuators replaced in 2000).
Now here is the problem. The insurance company, and the dealer it seems, are saying that it's the motor seals and its age related, not related to the break-in. Therefore they are refusing to cover it and as well are trying to get me to pay $475 labour because they tore the whole interior apart to find out it was the motor under the rear seat (5 minutes to remove 4 bolts) that was the problem.
Do you have any advise? I have a tough time believing that the top would work fine up until this break-in and then the seals would magically fail at this precise moment in time.
