The frothing issue comes into play only at a much more grossly overfilled point.
Is the 3mm high visible after the car's been run and the oil rechecked? Because if it was 3mm high immediately after filling the car, and BEFORE the engine was started, the oil filter probably took in the overage and it'd be just about perfect now.
I would definitely not worry about it.
If you really want to see how to overfill oil, try having either one of the two VW dealers I've gone to for my TDI do your oil change. Then, after you point out the error, listen to the first claim that "you're not supposed to check the oil after letting the car sit. Otherwise all the oil in the head and galleys will go into the pan, giving you an inaccurate reading." My response to that: you're fired!
