Paul, it shouldn't really work the way you're describing it. Was there no police report? What does your insurance say? If it was your fault, your insurance will take note and you will pay more for your insurance. It is worth sorting this out properly. If you have as much damage as you seem to suggest, there has to have been a police report and it is their job to issue a citation...thereby assigning fault. Don't give up on your car, yet, of your case. Let us know how things turn out.
