I tried to do the same thing you want to do. Though we live in a mild climate, I wanted to wait until we were in the spring, rather than have the top replaced in late fall. I met, in October, I think, with the dealership's service manager, who agreed that the original top was flawed. He agreed to wait until the spring to replace the top, which is what we did. The key thing was that the flaw was acknowledged, and hopefully in the computer system, as soon as possible after being recognized.

When the top was replaced the next spring, there was some other fault with it - the service manager brought it to my attention and had already ordered another top. We have the blue top, and apparently there were only 2-3 replacements in the country at the time (2 on the west coast where we are, another on the east coast). As I recall, there was a problem with each of the tops which were in the US. After installing one or two of the bad ones, the service manager made sure he inspected them before allowing them to be installed. They finally got one from Sweden that was okay.

The top I now have is, I guess, okay. I think it's too loose, across the top, and the piping along the edges, above the side windows, is not as straight a line as I think it should be. I've tried to push it wit th dealer a couple of times, but they stand by a position that it's within spec and won't adjust it. I guess I should try taking it elsewhere, but I'm noy sure where. Lessons learned, though the original top was flawed, you have to be careful what you ask for, and, I think, the tops are fit better at the factory than in a dealership - just because the factory has te better environment for fitting them.
Try your dealer out on acknowledging the flaw now, but waiting 'til after the winter for replacement. Hope they'll work with you.
