I had to comment on the this one as we just went through this last month with my red 2001 SE, which gave it's life to save mine. There was never any question as to the car being totaled. But... USAA, did not want to give me anywhere near retail value for the car in spite of the fact we where able to show them 20 comps in the northeast where the asking price was in the $ 26,to $ 27 area for a car of the same condition and mileage.
Here's the problem, they, USSA, base their payoff NOT on retail, but what they call ACTUAL PRICE, i.e. what you COULD buy one if you wanted to roll around on the ground with the dealer. "Oh great, I tell them, you want me to go out and fight with some dealer for a couple of days to knock him down to the number you want to give me???" "Yes, they answered, take it or leave it".
As with you, the accident was completely the other guys fault I had had enough crap, see ya in court I tell them., and by the way court in New Jersey." Next day the snakes call back to say" oh we found you a car in Cherry Hill same miles, same year, and WE convinced the dealer to take our offer that we made to you $ 22,999." Now I know I'm trapped, can't go to the judge and say they didn't offer to make me whole. So we go look at the car. Seems ok, but someone had put Goodyear Eagles( undersized, and very soft compound on it) Which made the car look funny. I like to autocross as much as the next guy, but this is my company car, so I say to them it's not a true comp due to the non-stock tires. In the meantime I look around the lot and see the new black launch car 9-3SS I tell the salesmen, "I want to drive that one." I do and I never looked back, what a fun car, reminds me a lot of a TR6 I once had, even though it's a stick, and I'm driving in the city, I don't care, sell me the car. Which is what happened. I did get USAA up a little in there final offer due to the tires not being stock. If I haven't seen the launch car I might still be arguing with them. What wonderful folks those " good old texas boys" turned out to be ( USAA) only concerned with their bottom line, not the customers problems. Saab on the other hand helped us, and was real stand up when we ran into a small problem with the new car. And by the way that OnStar does work when the bags come out.
