Up here in Canada the contractor (or the City, if they were doing the work) pay. In fact many contractors now don't bother with the construction standards (identifying obstructions/holes of more than 3", etc.) and just let their insurance handle the claims....apparently this is cheaper for them as most people don't make the claim. Helps if you take photos of what you hit and record time and date.
You also see greater use of 'Road Closed - Local Traffic Only' signs. Avoid these routes as these 'disclaimers' help the contractor with any claims against him.
