How about a dragging clutch (or maybe you're not putting the clutch pedal all the way down)? Then the synchro will (correctly) hang onto the gear.

Now for actual problems...
You say the tranny has the updated "kit"? Does that mean you KNOW it's got the new tranny oil (MTF0063)? My 2001 didn't have that, so I switched to Redline MTL. Mine would occasionally hang in 5th, and that completely stopped with the new gear oil.
