When I first bought my old '01 convertible, the top was all out of whack. It closed at an odd angle, the 1st bow would smack the header on one side, the tonneau wouldn't latch on one side, etc. Eventually my dealer recalibrated it (after replacing the 5th bow microswitch that had gone bad anyway) and those issues were pretty much solved by the recalibration.
A leaking hydraulic cylinder on one side could do the same too if it didn't have enough pressure. But I suppose your fluid would be low if that scenario was occurring...
