Depends on what you plan to do with the car. If you intend to keep it until it falls apart (or equivalent), if you can't negotiate the other driver's insurance to not total the car, you can settle for whatever amount you can negotiate, and then buy the car back from the other insurance company. It will end up with a salvaged title, but that happened to me in 2005 with my five year old 2000 9-3 when I was rear-ended in a parking lot. I have been driving that same 9-3 ever since as my daily driver. The salvage title does not matter to me since I know the history of the car and what was repaired. I now have 219,000 miles on the car.
