now incorporated into most legal systems. If you own something, and it causes damage, you must pay. Its in Justinian's Digest, the European Civil Codes, the Louisiana Civil Code, and has been adopted into the body of the common law. It is not a sleazy, tricky, evil theory put forth by trial lawyers designed to undermine commerce etc. It is an ancient rule designed to make people responsible for their property, ie, not lend it to someone you know is an idiot, keep your property safe so that it cannot be stolen.
And you shouldn't condemn all plaintiffs' lawyers, as some do very good work in an environmental context and when people really are injured through no fault of their own.
