Here in Michigan the Title is held by the "owner", but lists the financing company's interest too. When selling a car the title is transfered by the "owner" signing it over to the purchaser(at the Secretary of State's Office if the seller is smart), but it can't happen unless the owner has a "Release of Lien" letter from the financing company. Therefore, the car is fully owned by the selliing party first.
Naturally the Dealers have special provisions to allow them to accept vehicles for which the Lien has not been released. But for the private seller I don't think it is possible. But then again, I don't do this often so there are probably lots of provisions I am not aware of.
