If your record is clean, hire a lawyer and tell him your story. Worst case: he goes to court and bargains with the prosecutor to knock it down to a "no points" offense and you pay a hefty fine. Come to think of it, you have a chance of this happening even if you have previous violations. The officer in your account sounds a little lame; why would he say he clocked you at 61 and then write you up for 40? Also, did you tell him that it was a Green car like yours?

If you don't hire a lawyer, still ask for a court date and ARGUE your case to the judge. The officer might not even show which would get a dismissal before you even start arguing. When arguing, take advantage of drawing a picture (chalk board, etc.) of what occured -- the more detail you provide, the more credibility you will be percieved as having (I won a motorcycle ticket by doing this with the officer DISAGREEING with my presentation all along the way). You still have a chance of prevailing by doing this.

DO NOT EVER just pay the fine, accept the higher insurance, and chalk it up as a loss -- you have some good options every time you get a ticket (it just gets more difficult to handle with the more tickets you start piling up over time). Unless the extra points aren't a big deal to you...Good luck!
