Comparo: U.S. Consitution and Cdn Charter of Rights Posted by dparadis [Email] (#2915) [Profile/Gallery] (more from dparadis) on Fri, 29 Oct 2004 18:24:48 Members do not see ads below this line. - Help Keep This Site Online - Signup |
Yesterday, a canadian citizen (Jacques D'argis) obtained a favorable judgment against the CRTC (Canadian Radio-television and Telecommunications Commission), the Canadian equivalent to the FCC in the States.
His contention: It is illegal for the Canadian government to criminalize the act of receiving in Canada American satellite signals i.e. DirecTV, because of the Cdn Charter of Rights. Though everyone knows the government is only doing it to protect the Canadian media, no one had yet contested it.
This is a true David and Goliath story. So far, this individual has fought this battle on his own, WITHOUT A LAWYER!!! Ha has been at it for over 5 years!
Heard him on the radio today explaining his battle. He is self-taught on the matter and is highly knowledgeable. A true inspiration (there's a movie in there I'm sure!!!)
It is an area that I have been wanting to better understand for many years and this individual really motivated me to do it. One of his assertions is that, in regards to freedom of speach, the Cdn Charter is stronger because of its reference to freedom of expression versus freedom of speach for the Freedom of Rights (all theoretical of course...).

The punch line! Does anyone know of a web site (or a reference) which compares the two? Heck, while I'm at it, wouldn't mind better understanding the French system also.
Oh Yeah. This is WWWOT!!! :-)
Thanks!
