I learned that the hard way. Our contract also had the "new" box checked, & they even made me initial it for verification. But we still got scammed out of 15 months of warranty.

The dealer (Tynan's in Fort Collins, Colorado) represented the car as a "Saab Corporate Lease," explaining that a Saab Corporate employee had been using it. They told us that Saab considered it a new car since it had never been sold to a "regular" person. The car was a '99 that we bought in October of 2000. It had 16,000 miles on it. They said the time portion of the warranty would be started from the date of our purchase, but they couldn't roll back the odometer & we would only get the remaining 34k mi (forfeiting the 16k mi already on the clock). We figgered that was fine, since we didn't expect to drive much more than 8k mi/yr. That would put us right near 50k mi at the end of 4 yrs.

Fast-forward nearly 3 yrs later, to Fall of '03. Our air distribution drum died, & with Winter on the way we had to have it working in order to defrost the windshield. We had a little over 40k mi on the odometer, so we take it back to Tynan's for the repair. The service writer says we're OOW. Since August. And we'll have to cover the $1,300 repair ourselves.

We then talked to the original salesman, the sales manager, the service manager, & the owner. The saleman said he "couldn't remember." (Both the sales mgr & service mgr said this response was highly unusual for this saleman, because "he always remembers everything about his sales," & the sales mgr had worked with him for more than 9 yrs!) The sales mgr & service mgr both said to contact Saab Customer Service, while the owner decided to ignore us. Saab Customer Service didn't want to help because we hadn't done all the oil changes at the dealer. (The dealer was using bulk 5W-30 conventional oil for all their changes, even though the manual suggested ACEA A3-rated semi-synthetic at a minimum. I was using Castrol Syntec full syn instead.) Saab eventually agreed to buy the parts, but that was only $300 of the repair. The service mgr then responded ethically & did what he could about discounting the labor for us. We had to cover the many hundreds of dollars that remained.

I still have the contract with the "new car warranty" line checked & the "used car, sold as is" line crossed out. The hundreds of dollars it cost us only fostered bad customer relations & continues to generate bad word-of-mouth advertising for them. The funny thing is, we've just passed the 4 yr/50k mi mark without further warranty repairs being needed. All they had to do was honor their contract & we would've been happy. It wouldn't have cost them anything more. But now we tell everyone to avoid this dealer like the plague. Unless, of course, you want to be lied to & cheated.
