i was driving from vt back to boston a few weeks back and was stopped in nh for an expired registration. now, this was news to me as i did not rcv anything in the mail asking me to renew my registration (which i have rcvd before). anyway, the cop was called away to an accident and gave me the ticket, but also said that i was lucky because he was supposed to tow the car, but had to go to the accident.
the situation: i responded in the mail asking to contest the ticket. i then called the mass rmv and asked what the issue was; that i never rcvd the notice to pay. they said that since i moved in from out of state, that my license and registration records were not merged. therefore, when we bought the new house a year ago and i updated my address on line and rcvd the address change stickers, my registration was never updated even though i had the sticker on the form in my car. thus, the renewal notice went to the old address and was never fwded. subsequently, i never paid.
my question: even though my plates are visible every time i drive, i seldom look at them. do i have a leg to stand on here in court? i was never told i needed to merge my records and made a few assumptions. am i at fault anyway? btw, the notice of my hearing states that it is a criminal hearing, this seems a little gross, does this make sense?
