Even if the guy has a perfectly working car and a photo of him inside grinning widely, it is illegal to represent that car with the title from a different car.
One reason this smells is that assuming everything is on the level, that guy can go to his Department of MV and get a new title issued. Yes, he will have to present a bunch of paperwork, but that is the legal way to do it.
The reason Yaofeng should NOT do it is that as far as I know, you can't sell a title without the car. Most states require you (the owner) to sign over the title when you sell the car, and there is a lot of fine print on there about misrepresentation. To just hand over the title and play dumb is NOT going to shield you from legal liability. "It's his problem" is true - but it's your problem, also.
If Yaofeng sells the title to this guy, the best possible outcome is that the guy is totally on the up and up, and drives his car in a sane and responsible manner until he junks it. The worst possible outcome? Too many to list. The guy is using the title as a scam to sell cars that don't exist. Now you have to hope that he doesn't get caught. If he's out of state, it can become a Federal problem, as you're crossing state lines. If he uses it to title a car, and that car is involved in an accident, you open yourself up to legal liability, and yes, criminal prosecution (misrepresentation of a legal document, the title).
Could selling the title work out OK? Possibly yes. But the downside on this is pretty far down.
